Terms and Conditions General We put forward all quotations and accept all orders subject only to the terms and conditions which follow, and to the exclusion of all other guarantees, conditions or warranties (including any as to quality and fitness for a particular purpose), whether express or implied by statute or common law or otherwise. If a customer order contains conditions, such conditions are only deemed to be binding insofar as they are not inconsistent with our terms and conditions. No additions to or variations from our terms and conditions shall have effect unless we accept such variation in writing under the hand of a Company Officer. Our catalogue, price list, phtographs, product descriptions or other advertising matter shall not form part of any contract between us. We reserve the right to modify designs, photographs and product specifications without notice. Prices We will endeavour to maintain prices quoted, but we reserve the right to increase prices to take into consideration increases in costs incurred between acceptance of and delivery of an order. All prices quoted are in pounds sterling (£) and are subject to Value Added Tax at the prevailing rate. Delivery We will use our best endeavours to deliver promptly, but will be under no liability whatsoever for a delay in estimated delivery times or failure to deliver from any cause. The delivery operative will normally be unaccompanied; in no event will we be liable for any action of the purchaser or their employees. The purchaser will indemnify Freedom of Speech Ltd against all claims, proceedings, demands and costs arising there from. Deliveries will normally be made to the most convenient ground floor external door available. Goods MUST be inspected upon delivery and refused if any damage is found. Failure to notify us of any visible damage may result in claims not being accepted after the item has been signed for. Any visible damage should be identified to the delivery personnel and noted on their delivery note at the time of refusal. It is your responsibility to ensure that you or the person you've nominated to receive the delivery, have signed for the correct number of goods delivered. Your statutory rights are not affected. Delivery Discrepancies For delivery discrepancies please contact our head office on 01903 263007. All delivery discrepancies must be reported within 14 days from the date of delivery. Any discrepancies outside of this time will be rejected. Ownership of Goods The title and property in goods supplied by Freedom of Speech Ltd does not pass until full payment has been received by us, however the risk in respect of such goods passes to the purchaser at the moment of delivery, Until title in goods passes the purchaser shall hold the property of Freedom of Speech Ltd in trust, If payment becomes overdue or the customer becomes insolvent, commences winding up procedures, commits an act of bankruptcy or has a Receiver or Administrator appointed, Freedom of Speech Ltd may immediately reclaim the goods, if necessary by entering premises owned or occupied by the purchaser or the customer of the purchaser. Insurance of Goods After delivery, goods accepted by the customer shall be their responsibility with regard to insurance. Governing Law All our quotations shall be put forward and made in England, and shall in all respects be construed and operate under English Law. Cancellation Orders cannot be cancelled, except with our written consent and on terms that will indemnify Freedom of Speech Ltd against any loss. Returns Any product can be returned for whatever reason for a refund of the cost of the product as long as the product is returned in its original condition and packaging. Software cannot be returned if the security seal has been broken unless there is a hardware defect i.e. the CD/DVD media is physically defective/broken. Please ensure that software, computer peripheral, DVD, video and audio products have unopened packaging and/or seals, unless the item is faulty. To receive the refund, the product must be received by our Returns Department in its original condition and have been sent to us within 14 days of your receipt of the goods at the following address: Returns Department, Freedom of Speech Ltd, Columbia House, Columbia Drive, Worthing. West Sussex, BN13 3HD. You will be fully refunded, including return of the delivery costs for the UK and proof of posting for Europe, for any product, that is damaged, faulty or incorrectly shipped or any circumstance that is in our error. To return a defective or incorrectly shipped item, please contact Freedom of Speech's Support team by email: support@freedom-speech.co.uk telephone on 01903 264008. They will provide you with a "Returns Authorisation Number." When returning your goods, please enclose a note giving the reason for the return and quote your unique Returns Authorisation Number (RMA), wrap the package securely and send the package to the above address by guaranteed postal delivery. In the case of a defective product, please provide a full description of the fault, quote your unique Returns Authorisation Number and return the defective item in its original box (if any), with all warranty cards, licenses, software, manuals and accessories to the above address by guaranteed postal delivery. Once received and confirmed to be defective, we will dispatch a replacement item to you (normally within 3 working days). For your protection, we recommend that you use a recorded-delivery service where a signature is required upon delivery. Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error or the item is faulty. If we do not receive the item(s) back from you, we may arrange for collection of the item(s) from your residence at your cost. If non-faulty returned goods are not shipped back to Freedom of Speech Ltd using a recorded delivery service and do not arrive at Freedom of Speech Ltd, then Freedom of Speech Ltd cannot guarantee that it will be able to provide you with a credit for those items. Guarantee All hardware accessories come with a 1 year manufacturer’s ‘return to base replacement’ guarantee. Distance Selling Regulations The Distance Selling Regulations 2000 are designed to protect customers who are not physically present with the seller at the time of purchase. They cover purchases made via email and the internet, together with telephone and mail order. They only apply to transactions between businesses and consumers (individuals acting outside the course of their business) and do not include business-to-business contracts and auctions. Under the Regulations, consumers have the right to details in writing about the supplier and the terms of the transaction, written confirmation of their orders, further information, including a notice of cancellation rights, the complaints procedure, after-sales services and guarantees & delivery within 30 days unless otherwise agreed. Consumers have a cooling-off period of seven working days in which to cancel the contract, starting from when the goods are received, without having to give a reason. There are some exceptions to these rights of cancellation, including sealed software which has been opened. If an opened software boxes/envelope/package is found to have a defective CD/DVD, this media will be replaced.
